SELLER GUIDE — 2026

Selling your home
in Mallorca

Price it from evidence, prepare the papers early, and know your tax before you sign. This is how a sale works in 2026.

Villa terrace and pool, Mallorca

THE SHORT ANSWER

A clear sale, step by step.

A sale in Mallorca runs: valuation, documents, marketing, a private contract with a deposit, then completion before a notary. With the papers in order, most of the time goes on finding the right buyer.

Prepare early: title deeds, a fresh Land Registry extract, the energy certificate, the habitation certificate (cédula) and a certificate that community fees are paid.

Tax falls on the gain, not the price. Non-resident sellers pay 19% capital gains tax, and the buyer holds back 3% of the price as an advance on it. Municipal plusvalía tax may also apply.

THE PROCESS

Seven steps to completion

Valuation

A price set from recent sales and live and off-market evidence, not portal averages.

01

Documents

Deeds, Land Registry extract, cadastral reference, energy and habitation certificates, community and IBI receipts. Mismatches between the Registry and the Cadastre are the most common delay, so we check them first.

02

Presentation

Photography, film and floor plans. The energy rating must appear in every advert.

03

Marketing

Shown privately to qualified buyers first, or listed publicly if you choose.

04

Offer and private contract

Price and terms agreed, then the deposit contract (arras), usually 10% of the price.

05

Completion

Signed before a notary. Any mortgage is cancelled from the proceeds, the 3% retention is withheld if you are non-resident, and the balance is released to you.

06

After the sale

Non-resident sellers file the capital gains return (Modelo 210) and reclaim any part of the 3% retention that exceeds the tax due.

07

COSTS AND TAXES

What you pay when you sell

Agent commission

Freely agreed. The market range in Mallorca is commonly 3% to 6% of the price, plus 21% VAT.

3% – 6% + VAT

Capital gains tax (non-residents)

19% on the net gain: the sale price less the purchase price, purchase costs and documented improvements.

19% of the gain

Capital gains tax (residents)

Spain's savings scale, from 19% to 30% depending on the size of the gain.

19% – 30%

3% retention (non-residents)

The buyer withholds 3% of the price and pays it to the tax office as an advance on your tax. An advance, not an extra cost.

Advance on tax

Plusvalía municipal

Town hall tax on the increase in the land's value. Not due if you sell at a loss. For a non-resident seller, the buyer pays it on your behalf, usually from the price.

Set by the town hall

Certificates and lawyer

Energy and habitation certificates, the community certificate and your lawyer's fee.
